Definitions

· App – An application created for an Apple iPod Touch, Apple iPhone or Apple iPad or any future versions of the same.

· Suggester – any individual who submits an idea for an app, and by doing so is required to enter their name and e-mail address, is classed as a suggester and is not said to have “signed up” to www.iwantthatapp.co.uk.

· Developer – any individual who signs up to www.iwantthatapp.co.uk and pays the £10 GBP fee.

· For the purpose of the above:

o ‘any individual’ includes a body corporate

o signing up means joining www.iwantthatapp.co.uk (‘the website’) as a developer of software by providing information required by the website and complying with all other requirements of the website

Apple

1. The website was created and is owned and maintained by an individual with no connection to Apple and, for the avoidance of doubt, who is not an agent for Apple.

Suggesters

1. The Suggester disclaims any and all intellectual property rights in the ideas which they submit. For the avoidance of doubt, the Suggester will have no right to claim ownership over such ideas.

2. Without prejudice to the operation of clause 2 in the section entitled ‘Other’ below, the name of the Suggester alongside their suggested app will be viewable on the website by all developers. No other information from this individual will be shared or published without their permission.

3. There is no guarantee than any suggested app will end up being produced or be published whether in the app store or elsewhere.

Developers

1. The developer is required to pay a non-refundable fee of £10 GBP to be able to view all the apps suggested up to that point, and all the apps suggested in the 6 months thereafter or until the operation of the website ceases. After 6 months, the developer may choose to pay another non-refundable £10 GBP fee to cover themselves for the next 6 months or until the operation of the website ceases. This is all the £10 GBP covers. For the avoidance of doubt, the owner of the website does not have any intellectual property rights in the app suggestions and therefore is unable and does not purport to transfer any such rights to the developer.

2. No information of the developers will be shared or published without their permission.

3. All app suggestions will be available to all developers who have signed up to the website and have paid the £10 GBP fee. No developer shall have a better right than any other developer to use in any way the app suggestions.

4. No app developer will have rights to claim sole responsibility or ownership over any app suggested on the website

5. If a developer creates an app:

a) whose idea for which is based wholly or partly upon a suggestion or suggestions appearing on the website; and

b) which is to be published on the Apple store

the developer shall:

i. give notice of the forthcoming publication by email to This e-mail address is being protected from spambots. You need JavaScript enabled to view it not less than 7 days before such publication; and

ii. include within the app description (and with reasonable prominence) the following credit: “This app was suggested at www.iWantThatApp.co.uk”

The notice shall include:

i. the date of the intended publication on the Apple store

ii. the name of the app

iii. a general description of the app

iv. the name of the developer

v. a direct link to the suggested app on the website and/or the suggesters name who suggested the app

Other

1. The website is simply a way to enable the communication of suggestions for apps between individuals and developers. It is not the function of the website to assess the workability, viability or commercial value of the ideas.  The website has not carried out and will not carry out any due diligence or any other investigation as to whether there are any intellectual property to the ideas and to whom such rights belong.

2. The owner of the website reserves the right to publish or not publish or remove, any app suggested on the website for any reason and without giving any reasons.

3. The owner of the website reserves the right to cease the operation of the website at any time without liability to anyone.
